Who needs professional indemnity insurance in New Zealand?
Anyone paid for their advice, design, expertise or professional service. Engineers, architects and building designers, accountants and bookkeepers, IT consultants and software developers, real estate and property professionals, surveyors, marketing and management consultants all commonly carry it. Many professional bodies, licensing schemes and client contracts require it — and even where it's optional, one claim can cost more than years of premium.
What does 'claims made' mean, and why does it matter?
Professional indemnity policies respond to claims made against you during the policy period — not to when the work was done. That has two consequences. First, you need the policy in force when a claim arrives, even if the work was years ago. Second, most policies have a retroactive date, and work done before it isn't covered. Keep cover continuous and check the retroactive date whenever you move insurers; your broker will do that check for you.
What is run-off cover?
When you retire, sell up or close the practice, claims can still arrive about work you did while trading. Run-off cover keeps a professional indemnity policy in place for those claims after you've stopped working, usually for a set number of years. Talk to your broker well before you wind down — the options depend on your current policy and your profession.
Does professional indemnity cover injury or property damage?
Not on its own — professional indemnity responds to financial loss caused by your advice or service, while injury and property damage sit under public liability. Many insurers offer combined professional and public liability policies for professionals, and some add statutory liability and cyber in the same package. Your broker will recommend whether a combined policy or separate covers suit you.
What limit should I carry?
Start with what your contracts and professional body require — engineering and design contracts, in particular, often specify minimums. Then think about the size of the projects you advise on and what a worst-case claim would look like. Premiums depend on your profession, fee income, claims history and the limit you choose, so your broker gathers competitive quotes you can compare for your situation.
Am I covered for work done by subcontractors or freelancers?
Often you are covered for your liability to clients for work done on your behalf, but not for claims the subcontractor faces directly. It depends on the wording, and the detail matters if you regularly bring in outside expertise. Tell your broker how your practice is structured and we'll make sure the policy reflects it.
